What Is a Living Will – And Should You Have One?

Have you ever considered what would happen if you became seriously ill and couldn’t communicate your wishes? It’s not something any of us like to imagine—but planning ahead can protect you and your loved ones from difficult decisions later on.

That’s where a Living Will comes in.

What Is a Living Will?

A Living Will, also known as an Advance Decision, is a legal document that lets you state your wishes about medical treatment in case you become unable to make or communicate those decisions yourself.

For example, you might choose to refuse life-sustaining treatment like being kept alive on a ventilator or by artificial feeding if there’s no chance of recovery.

Is a Living Will Legally Binding?

Yes. In England and Wales, a Living Will is legally binding under the Mental Capacity Act 2005, provided it:

  • Clearly sets out the treatments you wish to refuse
  • Is written and signed properly
  • Is made while you have full mental capacity

Doctors and medical teams must follow it, and it helps avoid confusion or conflict during times of crisis.

What’s the Difference Between a Living Will and a Lasting Power of Attorney?

A Living Will lets you state your decisions about specific treatments.

A Health & Welfare Lasting Power of Attorney (LPA) lets you appoint someone else to make decisions on your behalf.

Many people choose to have both. That way, you can give clear instructions (Living Will) and also appoint someone you trust to act for you if something unexpected arises (LPA).

Why Should You Make One?

  • You stay in control of your treatment and dignity
  • It removes stress from your family, who might otherwise have to guess what you would want
  • It helps doctors act quickly and confidently in line with your wishes
